TERMS OF SERVICE

OVERVIEW

Web Dynamix Website Maintenance plans are delivered and operated by Web Dynamix. Throughout this document, the terms “we”, “us” and “our” refer to Web Dynamix. Web Dynamix offers these Website Maintenance plans conditional upon acceptance of all terms, conditions, policies and notices stated here.

Please read these Terms of Service carefully before engaging in our services. By taking up one of our Website Maintenance plans, you are engaging in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”).

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes.

 

1.  GENERAL DESCRIPTION OF SERVICES

Web Dynamix is an online website maintenance service that offers website maintenance plans to support owners and operators of websites running on single site or multiple site installations for WordPress content management system driven websites.

Specifically, we offer 3 website maintenance plans: “Starter”, “Boost” and “Extra”. All of these plans are offered on a no-contract month to month basis.

We reserve the right to modify your website in the undertaking of our services to you, including website features and plugins that are crucial in the maintenance of your site. We will not be liable to you or any third party should we exercise such right. We will also not be liable to you or any third party for any new features that augment or enhance the then-current services on offer from us.

 

2.  SPECIFIC DESCRIPTION OF SERVICES

Below is a list of the services you will receive with our maintenance packages. It also forms our requirements to you for the specific maintenance plan you have signed up for.

 STARTER MAINTENANCE PACKAGE

  • Update WordPress, plugins and themes (once a month)
  • Monthly website backups
  • Maintain and monitor basic security measures

BOOST MAINTENANCE PACKAGE

  • Update WordPress, plugins and themes (twice monthly)
  • Fortnightly website backups
  • Maintain and monitor basic security measures
  • Fortnightly spam cleaning
  • 30 minutes each month of technical support, design changes or content management

EXTRA MAINTENANCE PACKAGE

  • Update WordPress, plugins and themes (weekly)
  • Weekly website backups
  • Maintain and monitor basic security measures
  • Weekly spam cleaning
  • 1 hour each month of technical support, design changes or content management
  • Additional technical support, design changes and content management hours charged at $75 per hour (normally $100 per hour)

In addition to the maintenance package services above, all of our maintenance plans come with No Lock-In Contract. You can cancel at any time.

 

3.  PAYMENT

All of our maintenance plans are paid one month in advance and commence at the time of sign-up on our site, with recurring payments on the same date every month unless, and until cancelled. Our maintenance plan payments are processed via Direct Debit. Our Direct Debit facility gives you the option to set up your direct debit using your bank account or credit card credentials.

Please be advised, when you sign-up with us, the first month’s payment will be charged to your credit card or bank account, and any subsequent months will be charged automatically every month from then on until you cancel the service.

Prices for our maintenance plans and services may change at any time at Web Dynamix’s discretion. If our prices do change, we will endeavour to contact you prior to the new charges being applied.

 

4.  YOUR REQUIREMENTS

Upon signing up to one of our maintenance plans, you are required to supply login credentials with administrator privileges for the WordPress website you want us to maintain. We will get in touch with you soon after you signing up to obtain these credentials. It is crucial we receive these as soon as possible. If you’re not sure whether you have administrator privileges for your site, we can advise you on this. If we don’t receive these credentials, or if the credentials don’t have administrator privileges then we cannot begin maintaining your site.

 

5.  CANCELLATION

Our month by month maintenance plans can be cancelled at any time. If you wish to cancel your monthly subscription plan, then please contact us on info@webdynamix.com.au to do so. Please contact us at least 3 business days prior to your next payment to ensure you don’t pay for the next month.

Once you have cancelled your maintenance plan, your current plan will still be valid until the end of your currently paid month, at which point all maintenance services from us will stop.

Should you wish to cancel your maintenance plan, you acknowledge that no refunds will be given on amounts you have already paid.

If you wish to resume or restart our maintenance plan services, simply get in touch with us, or sign up again through our website.

We reserve the right to cancel this agreement for any reason, at any time. Should we decide to cancel services, we will send you a cancellation notice electronically to the email address we have on record for you.

 

6.  PRIVACY STATEMENT

We are fully committed to protecting the privacy of our clients. Any information including, but not limited to unique usernames, passwords and any other sensitive information, required and collected by us to maintain your website is strictly confidential.

 

7.  ACCURACY OF BILLING AND ACCOUNT INFORMATION

You agree to provide current, complete and accurate purchase and account information for all maintenance plans purchased through our website. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

 

8.  THIRD-PARTY LINKS

Certain content, products and services available via our services may include materials from third-parties.

Third-party links on our site or through our service may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.

 

9.  INDEMNIFICATION

You agree to indemnify, defend and hold harmless Web Dynamix, directors, agents, contractors, service providers, subcontractors, suppliers and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third-party.

 

10.  CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time at this page.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms of Service constitutes acceptance of those changes.
